Where clients have been able to resolve all issues in relation to childcare and financial matters, they often look to divorce or dissolve their civil partnership.  We can assist in this process on a fixed fee basis. 

Fixed Fee Divorce Lawyers Glasgow, Scotland

Where there are no children under the age of sixteen and a couple have been separated for more than one year, a Simplified Divorce Application might be appropriate.  Where the period of separation is more than one year but less than two, the other party’s consent to the granting of Decree of Divorce or Dissolution is required.  Where parties have been apart for more than two years no such consent is required.

In either case, the divorce process is undertaken by way of an Application to the Court.  We can assist in the completion of that Application, including the swearing of an Affidavit and submission of the Application to the Court.  We will then liaise with the Court regarding the progress of your Application, advise you when your divorce has been granted and ensure that you receive the final Extract Decree when this is issued.  Our fee in relation to this work would be fixed at £300, including VAT and court outlays.  The only variation to that would be if additional costs of Sheriff Officers’ service are required.

Where a couple are in a Civil Partnership, the process is almost identical to the above and our fees are the same.

In situations where there are children under the age of sixteen, it is not possible to proceed under Simplified Procedure and a different type of court action requires to be raised.  Although the grounds of such a divorce or dissolution would remain the same, an Initial Writ needs to be lodged with the Court and thereafter served on the other party.  Once service has been affected, Affidavits confirming the period of separation and detailing the arrangements which have been made for the care of any children of the marriage have to be prepared and lodged with the Court.  Our fixed fee in relation to all work requiring to be done is £1400.  This fee is inclusive of VAT and outlays.  The only variation to that would be if additional costs of Sheriff Officers’ service are required.
